Life gets very complicated if you are convicted on a 2d DUI charge or 3d DWI in New Hampshire.

While a first offense is only a Class B Misdemeanor, a 2d DUI charge is a Class A Misdemeanor. You also face these criminal penalties:

  • $750 fine.
  • Three-year loss of license.
  • Thirty (10 if prior offense was between two and 10 years prior) days minimum in jail, and seven days in the DWI Offender Intervention Detention Center if second offense was within two years of a prior offense.

The Department of Motor Vehicles will fine you and suspend your license upon a second offense as follows:

  • $500 to $1000 fine.
  • Three months to one-year loss of license with any prior offense (within seven years).
  • You also must complete a seven-day residential Impaired Driver Intervention Program.
  • Any vehicle registered to an individual losing a driver’s license shall be revoked for the same period as loss of license.

The Multiple Offender Program (MOP) at the DWI Offender Intervention Detention Centercosts approximately $1,500. Enhanced penalties may be imposed if a minor was in the vehicle, you were speeding or driving recklessly, an accident resulted with personal injury or property damage, or you had a very high BAC.
